How do I disable max encoding on my mini, but keep the rest of the functionality. Mac OS X.9.3

The MAX option is there when you need it. Therefore, you can think of it as disabled provided you're not encoding to H.264 using Matrox H.264 presets in supported applications such as Compressor or Episode.
